3. Service Engagement
3.1 Free Scans
Free accessibility scans are provided for evaluation purposes only and include automated testing of your website. Free scans do not constitute a comprehensive audit and are not suitable for legal compliance purposes.
3.2 Paid Services
Paid accessibility audits and services will be provided according to the scope defined in our proposal or service agreement. Pricing and deliverables will be confirmed in writing before work begins.
3.3 Timeline
Service delivery timelines will be specified in your service agreement. While we strive to meet all deadlines, timelines are estimates and may be subject to adjustment based on project complexity.
4. Payment Terms
4.1 Pricing
Prices for our services are listed on our website and are subject to change. Prices will be confirmed in your service agreement and will not change once agreed upon.
4.2 Payment Schedule
Unless otherwise agreed:
- One-time audits: 50% upfront, 50% upon completion
- Ongoing services: Billed monthly in advance
- Payment is due within 14 days of invoice date
4.3 Late Payment
Late payments may incur a fee of 1.5% per month or the maximum allowed by law. We reserve the right to suspend services for accounts with overdue balances.
4.4 Refunds
Due to the nature of our services, refunds are generally not available once work has commenced. Exceptions may be made at our sole discretion for extenuating circumstances.
5. Client Responsibilities
To enable us to provide effective services, you agree to:
- Provide timely access to your website and necessary credentials
- Provide accurate information about your website and accessibility requirements
- Respond to queries and requests for information in a timely manner
- Review and implement recommended accessibility improvements
- Inform us of any changes to your website during testing
6. Scope and Limitations
6.1 Testing Scope
Our testing covers the pages, components, and functionality specified in your service agreement. Testing is based on WCAG 2.2 guidelines at the conformance level agreed upon (A, AA, or AAA).
6.2 Accuracy
While we strive for complete accuracy, we cannot guarantee that our testing will identify every accessibility issue. Accessibility testing is a best-effort service based on current standards and guidelines.
6.3 Not Legal Advice
Our services do not constitute legal advice. We provide technical accessibility assessment and recommendations. For legal compliance questions, consult with a qualified attorney.
7. Confidentiality
We will treat all information about your website, business, and users as confidential. We will not disclose this information to third parties except:
- To our contractors who perform testing services (bound by confidentiality agreements)
- As required by law
- With your explicit permission
You agree that we may use anonymized information from audits as case studies or for improving our services.
8. Intellectual Property
8.1 Your Content
You retain all rights to your website content. By using our services, you grant us a limited license to access and test your website.
8.2 Our Deliverables
Upon full payment, you receive a license to use our audit reports and recommendations. We retain copyright in our testing methodologies, tools, and templates.
9. Liability and Disclaimers
9.1 No Warranty
Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that implementing our recommendations will ensure full legal compliance or prevent accessibility-related claims.
9.2 Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims arising from our services shall not exceed the fees paid by you for the specific service giving rise to the claim.
9.3 Exclusion of Damages
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, data, or business opportunities.
10. Cancellation and Termination
10.1 By Client
You may cancel services with 30 days' written notice. You remain responsible for payment for services rendered up to the cancellation date.
10.2 By Vantage Access
We may terminate services immediately if you breach these terms, fail to pay, or if continuing services would violate applicable laws.
10.3 Effect of Termination
Upon termination, you must pay for all services rendered. We will provide deliverables for completed work upon receipt of payment.
11. Changes to Services and Terms
We reserve the right to modify or discontinue services with notice. We may update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the new terms.
12. Dispute Resolution
12.1 Governing Law
These terms shall be governed by the laws of Spain, without regard to conflict of law principles.
12.2 Jurisdiction
Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
12.3 Good Faith Resolution
